HADİSLERDE MESKEN MAHREMİYETİNİ TEHDİT EDEN UNSURLARA KARŞI ALINAN ÖNLEMLER

Abstract

Günümüzde bilgi ve iletişim teknolojileri ile sosyo-kültürel alandaki gelişmeler, mahremiyet algısının dönüşümüne ve sınırlarının değişimine neden olmaktadır. Kişilerin özel hayat alanlarını daraltan ve konut dokunulmazlığını tehdit eden pek çok gelişmenin yaşandığı son zamanlarda mesken mahremiyeti ihlalleri, üzerinde dikkatle durulması gereken önemli bir sorundur.Dinimiz, insanda fıtrî bir duygu ve değer olan mahremiyeti korumayı hedef edinmiş, aile hayatıyla doğrudan ilişkili olduğu için mesken mahremiyetini düzenleyen ilke ve esasları ortaya koymuştur. Bu araştırmada hadislere göre mesken mahremiyetinin genel bir çerçevesi çizildikten sonra mesken mahremiyetini ihlal eden unsurların ve eylemlerin mahiyeti açıklanacaktır. Ayrıca mesken mahremiyeti ihlaline karşı Hz. Peygamber'in aldığı önlemler ve uyguladığı yaptırımlar, konut dokunulmazlığının korunmasına yönelik ilke ve esaslar, O'nun söz ve uygulamalarından hareketle tespit edilecektir

Nowadays developments in socio-cultural fields of information and communication technologies lead to the transformation of the perception of privacy and to changes in the private boundaries. Recent developments regarding limitations of private sphere and threats against residential privacy shows that this is a problem that needs to be addressed.Our religion gives great importance to protect the privacy of people which is an innate sense and value. In this regard it has laid out principals and basics regulating the residential privacy. After drawing an overall framework of residential privacy from the perspective of the Hadiths, this study will explain the nature of the elements and actions that violate the confidentiality of residential privacy. It will also uncover the performed precautions and sanctions against residential privacy and the principals and basics for the protection of residential privacy by our prophet moving from his words and actions
