Öğe Satım Sözleşmelerinde Alıcının Asli Edim Yükümlülüklerinin Milletlerarası Viyana Satım Antlaşması ile Türk Borçlar Kanunu'na Göre Karşılaştırılması(Bayburt University, 2023) Altay, YasinAccording to their self-characteristics, contracts for the international sale of goods bring and raise some rights and obligations to the parties, which are dubbed as buyers and sellers. For the contracts that are conducted internationally, the contradictions and non-contractual provisions that stem from the parties' national legislation lead to several problems. In order to solve such problems, the "United Nations Convention on Contracts for the International Sale of Goods" is prepared to establish a legal basis for the contracts. Today, the Convention, which 95 states are party as of today, was ratified on 1 August 2011 by Turkey. The Vienna Sales Convention is comprised of four sections and 101 articles, which mainly regulate the rights and obligations of the buyer and seller parties and the breach of the contract. In article 53 of the Convention, the buyer's obligations are outlined, and it is stated that the buyer must "pay the price" for the goods and "take delivery of them" as required by the contract and by the Convention. Similarly, the Turkish Code of Obligations art.232 imposes two primary obligations on the buyer as "paying the price" and "taking over the sold". This study addresses primary obligations and attitudes regarding the buyer's breach of contract and the seller's remedies under the articles of "Vienna Sales Convention" by comparing related articles of the "Turkish Code of Obligations".
