Özet
Bu çalışmada, felsefeciliği ile tanınan, aynı zamanda önemli bir fıkıhçı ve başkadı olan İbn Rüşd el-Hafîd'in fıkıhçılığı ortaya konulmaya çalışılmıştır. İbn Rüşd'ün fıkıhçılığı, ed-Darûrî ve Bidâyetü'l-Müctehid adlı eserlerinden tespit edilmiştir. Beş temel bölümden oluşan çalışmanın birinci bölümünde; İbn Rüşd'ün hayatı kısaca ele alınarak kendisine nisbet edilen yirmi sekiz fıkıh eseri hakkında bilgi verilmiştir. İkinci bölümde; İbn Rüşd'ün hüküm teorisi kapsamında, vâcib, mendûb, haram, mekrûh, mubâh, sıhhat, fesâd/butlân, edâ, kadâ', i'âde, azîmet ve ruhsat konularına/terimlerine yer verilmiştir. Üçüncü bölümde; İbn Rüşd'e göre İslam hukukunun ittifak edilen kitâb, sünnet, icmâ, istishâb ve kıyas delilleri ile ihtilaflı kabul edilen sahabe sözü, şer'u men kablenâ, istihsân, maslahat, sedd-i zeri'a ve amel-i ehl-i Medine delilleri işlenmiştir. Dördüncü bölümde; İbn Rüşd'ün delâlet anlayışı kapsamında lafızların, mefhûmun ve karînenin delâletleri konu edinilmiştir. Ayrıca lafızların delâleti kapsamında nass, mücmel-mübeyyen ve zâhir-müevvel lafızların delâleti; mefhûmun delâleti kapsamında da iktizânın, mefhûm-ı muvafakâtın, hitâbın ve emir ile nehyin delâleti ele alınmıştır. Son kısımda karînenin delâleti bağlamında Hz. Peygamber'in, fiil ve takrîrlerinin delâleti konusu ele alınmıştır. Çalışmamızın beşinci bölümünde ise, İbn Rüşd'ün ictihad ve taklid anlayışı, şer'î delillerin sıralaması ve tearuz konuları işlenmiştir. Bunların yanında, her bölümde ele alınan usûl konularının furû fıkha yansıması örneklendirilerek İbn Rüşd'ün fıkıh anlayışındaki usûl furû ilişkisi Mâlikî mezhebi ile mukayeseli olarak ortaya konulmuştur.
This study aims to present the jurisprudential contributions of Ibn Rushd al-?af?d, who is well-known as a philosopher but also served as a distinguished jurist and chief judge. jurisprudential thought has been examined through his works al-?ar?r? and Bid?yat al-Mujtahid. The study consists of five main chapters. In the first chapter, Ibn Rushd's life is briefly discussed, along with information on the twenty-eight juridical works attributed to him. The second chapter explores his theory of legal rulings, covering terms such as w?jib (obligatory), mand?b (recommended), ?ar?m (unlawful), makr?h (reprehensible), mub?? (permissible), ?i??a (validity), fas?d/bu?l?n (invalidity/corruption), ad?? (performance), qa??? (deferred performance), i??da (repetition), ?az?ma (rigorous practice), and rukh?a (dispensation practice). The third chapter examines the sources of Islamic law according to Ibn Rushd, addressing the unanimously accepted sources Kit?b, Sunnah, ijm??(consensus), isti???b (presumption of continuity), and qiy?s (analogical deduction) as well as the disputed sources, including qawl al-?a??b? (the sayings of a Companion of the Prophet (pbuh)), shar? man qablan? (revealed laws preceding the shar?'ah of Islam), isti?s?n (juristic discretion), ma?la?a (public interest), sadd al-dhar??i? (blocking the means), and ?amal ahl al-Mad?na (the practice of the people of Medina). The fourth chapter delves into Ibn Rushd's understanding of dal?lah (indications), focusing on alf?z (textual indications), mafh?m (the implied), and qar?na (circumstantial evidence). It further analyzes dal?lat al-alf?? (the textual indications) through na?? (the explicit), mujmal-mubayyan (the concise-elucidated), and ??hir-mu?awwal (the apparent-the interpreted). Additionally, dal?lat al-mafh?m (implied meaning) is discussed in terms of iqti??? (the required meaning), mafh?m al-muw?faqa (the aggreement meaning), khit?b (addressed speech), and the indications of commands and prohibitions. In the last part, the study examines the indications of the Prophet's actions and tacit approvals (fi?l and taqr?r). The fifth and final chapter discusses Ibn Rushd's views on ijtih?d (legal reasoning) and taql?d (imitation), the hierarchy of shar'i (legal) evidences, and the issue of ta??ru? (conflict). Additionally, each chapter includes examples illustrating the application of u??l (legal theory) in fur?? al-fiqh (substantive law), comparing Ibn Rushd's approach to that of the M?lik? school to highlight the relationship between legal principles and their practical implications in his jurisprudential thought.
