dc.description.abstractÇalışmaya konu olan Merğinânî'nin el-Hidâye adlı eserinde İslam Aile Hukuku ile ilgili Hanefî ve Şâfiî fakihlerinin ihtilaf gerekçeleri ortaya çıkarılmaya çalışılmıştır. Bu bölümde Nikâh akdi konusunda 32, Süt emme konusunda 5, Boşanma konusunda 34 ve Aile hukuku ile ilgili hadler konusunda 4 olmak üzere toplamda 75 meselede Hanefî ve Şâfiî fakihleri arasında ihtilaf olduğu tespit edilmiştir. Çalışma bir giriş ve iki bölümden meydana gelmektedir. Giriş bölümünde araştırmanın önemi, amacı, yöntemi, literatür özeti ve müellifin hayatı kısaca tanıtılmıştır. Birinci bölümde "Evlenme ve Süt emme" konusundaki "Hanefî-Şâfiî İhtilafları"; İkinci bölümde ise "Boşama ve Aile Hukuku ile ilgili Hadler" konusundaki ihtilaflar belirlenip diğer Hanefî ve Şâfiî kaynaklar yardımıyla gerekçeleri ortaya çıkarılmaya çalışılmıştıren_US
dc.description.abstractThe subject of the study, the work of Al-Hidayah by Merğinânî, the reasons for the dispute of Hanafi and Shafi'i jurists related to Islamic Family Law were tried to be revealed. Under this chapter, It was determined that there were conflicts between Hanafi and Shafi'i jurisprudents in 75 issues, 32 of which were about marriage contract, 5 about breastfeeding, 34 about divorce and 4 about family law. The study consists of a three parts first introduction and two other chapters that covers previous issues. In the introduction part covers the importance of the study, aim of the study, methodology, literature summary and the life of the author that are briefly introduced. In the first chapter, the conflicts were determined that Hanafi-Shafi'i Conflicts on Marriage and breastfeeding; In the second chapter reveals disputes that are related to the 'Divisions and Divorce and Family law related to the criminal offenses', with the help of other Hanafi and Shafi'i tried to uncover the reasons.en_US
