dc.description.abstractIn this research, Prof. İshak Emin Aktepe's work, The Concept of the Sunnah of Jurists in the early ages, was introduced. The author deals with the definition of sunnah and the debates about sunnah in the first and second centuries of Hijri, which were very influential in the formation of Islamic thought. The author started his work with a few questions raised about the content of the sunnah in the first century of Hijri. He brought up the questions reflecting the point of view of the faqih sects on sunnah and then discussed the principles on which the schools set out in making judgments from the sunnah sources. "What is the place of the sunnah among the shar'i evidences?" and "What is the relation of the Sunnah with other shar'i evidences?" are the questions he tried to answer. Answers were sought to these questions in order to determine the notion of sunnah, its content, judgment inference and ?adith criticism in the periods of the Messenger of Allah, Companions, T abi'in and later, according to Imam Abu Hanifa and Imam Malik. He gave special importance to Imam Shafi'i, who laid the foundations of Ahl al-?adith, struggled in the way of Sunnah, gave the k?h?abar al-wa?id its shar'i position in the revelation, fought against the school of Iraq and Ray and strengthened the Ahl-i ?adith against other schools. The author examined these issues in five chapters, which he strengthened with ?adith, analysis and discussions. In the study, besides the works of contemporary orientalist, Arab and Turkish researchers, classical sources were also cited. At the end of each chapter, he included a comprehensive review summarizing her conclusions. This work is considered one of the most important Turkish books investigating the historical development of the concept of Sunnah in the first centuries.
dc.description.abstractBu araştırmada Prof. Dr. İshak Emin Aktepe'nin Erken Dönem İslam Hukukçularının Sünnet Anlayışı isimli eserinin tanıtımı yapılmıştır. Yazar sünnetin tanımı ve İslam düşüncesinin oluşumunda çok etkili olan hicri bir ve ikinci asırdaki sünnetle ilgili tartışmaları ele almıştır. Müellif hicri birinci asırda sünnetin muhtevası hakkında ortaya atılan birkaç soru ile eserine başlamıştır. Fıkıh mezheplerinin sünnet hakkındaki bakış açısını yansıtan soruları gündeme getirmiş sonra ekollerin sünnet kaynaklarından hüküm çıkarmada hangi esaslardan yola çıktıklarını ele almıştır. Sünnetin şer'i deliller arasındaki yeri nedir? Sünnetin diğer şer'i delillerle ilişkisi nasıldır? sorularına yanıtlar aramıştır. Rasulullah, sahabe, tabiin dönemleri ve sonrasında Ebu Hanife ile İmam Malik'e göre sünnet mefhumu, onun muhtevası, ondan hüküm istinbatı ve hadis tenkidiyle ilgili değerlendirme kriterlerindeki yerini tespit için bu sorulara yanıtlar aranmıştır. Yazar, Ehl-i Hadis'in temellerini atan, sünnet yolunda mücadele eden, haber-i vahide şer'i konumunu veren, Irak ve re'y ekolüyle mücadele edip Ehl-i Hadis'i diğer ekollere karşı kuvvetlendiren İmam Şafii'ye ayrı bir önem vermiştir. Müellif bu konuları hadis, tahlil ve tartışmalarla güçlendirdiği beş bölümde incelemiştir. Araştırmada çağdaş müsteşriklerin, Arap ve Türk araştırmacıların eserlerinin yanı sıra klasik kaynaklara da atıf yapılmıştır. Her bölümün sonuna ulaştığı neticeleri özetleyen kapsamlı bir değerlendirme eklemiştir. Bu eser, ilk yüzyıllarda sünnet kavramının tarihsel gelişimini araştıran en önemli Türkçe kitaplardan biri kabul edilebilir.
