dc.description.abstractDomestic violence and violence against women are issues affecting many people every year in our country and the world, causing human rights violations for vulnerable people such as women, children, and the elderly, and require urgent solutions. Studies are conducted to protect the victims of violence, to prevent violence, and to conclude its effects in the national and international arena because of the importance of the concept of family. To protect the family and raise healthy and happy generations, states also have some responsibilities regarding violence. Various arrangements were made in our domestic law to fulfill the responsibilities imposed in our country by conventions regulated internationally and to which our country is also a party. No doubt, the most important of these regulations is Law No. 6284 on the Protection of the Family and the Prevention of Violence Against Women. Within the scope of this Law, the local authority, the judge, and in some cases, the law enforcement chief were authorized to take protective and preventive measures, to reduce the effects of violence on the victims and to reintegrate the victims of violence into the society by trying to prevent the repetition of violence. Because of its importance, domestic violence and violence against women are defined in the study, and protective and preventive measures in the Law No. 6284 are explained.
dc.description.abstractAile içi şiddet ve kadına yönelik şiddet, ülkemizde ve dünyada her yıl pek çok insanı etkileyen, kadın, çocuk, yaşlı gibi savunmasız durumda bulunan kişilerin insan hakkı ihlaline neden olan ve acilen çözüm bulunması gereken konulardır. Aile kavramının önemine binaen ulusal ve uluslararası alanda şiddet mağduru kişilerin korunması, şiddetin önlenmesi ve etkilerinin neticelendirilmesi adına çalışmalar sürdürülmektedir. Ailenin korunması, sağlıklı ve mutlu nesillerin yetiştirilmesi adına devletlere de şiddet konusunda bazı sorumluluklar düşmektedir. Uluslararası alanda düzenlenen ve ülkemizin de üye olduğu sözleşmelerle ülkemizde yüklenen sorumlulukların gerçekleştirilmesi için iç hukukumuzda çeşitli düzenlemelere gidilmiştir. Bu düzenlemelerden en önemlisi de şüphesiz 6284 sayılı Ailenin Korunması ve Kadına Yönelik Şiddetin Önlenmesine Dair Kanundur. Bu Kanun kapsamında mülki amir, hakim ve bazı hallerde kolluk amirine koruyucu ve önleyici tedbir alabilme yetkisi verilmiş ve şiddetin önlenmesiyle tekrarı engellenmeye çalışılarak, şiddetin mağdurlar üzerinde bıraktığı etkinin azaltılması ve şiddet mağdurlarının topluma kazandırılması hedeflenmiştir. Önemine binaen çalışmada aile içi şiddet ve kadına yönelik şiddet tanımlanarak, 6284 sayılı Kanunda yer alan koruyucu ve önleyici tedbirler açıklanmıştır.
